      Terms & Conditions

      These Terms & Conditions ("Terms") govern your booking and participation in any tour, charter or experience operated by Simba Sea Trips Co. Ltd. ("Simba", "we", "us", "our"). By booking a tour, you confirm that you have read, understood and agree to be bound by these Terms.

      1. Definitions

      In these Terms:

      • "Simba" means Simba Sea Trips Co. Ltd., operating under Tourism Authority of Thailand Licence No. 34/02111.
      • "You" or "customer" means the person making the booking and each person named on the booking.
      • "Tour" means any join-in group tour, private charter, or other experience operated by Simba.
      • "Booking" means a reservation for a tour made via our website, an authorised online travel agent, or directly with our team.
      • "Departure point" means Soho Pool Club at Boat Lagoon Marina, Phuket, unless specified otherwise.

      2. Booking & Payment

      All tour prices displayed on simbaseatrips.com and in our booking confirmation emails are all-inclusive: they include Thai VAT, booking processing fees, national park fees where applicable, insurance for eligible passengers, hotel transfers within Phuket, food and non-alcoholic beverages as described in each tour listing, and all equipment needed for the day.

      At checkout, you will have the option to pay the full tour price or to pay a deposit only to secure your seats. Where a deposit is paid, the outstanding balance is due on the day of your tour and can be settled at our office at Soho Pool Club, Boat Lagoon Marina, when you arrive for your tour. Your booking is confirmed upon receipt of either the deposit or the full payment.

      You will receive a booking confirmation email summarising your tour, pickup details, the amount paid and any balance still owing. Payment is processed securely through our booking partner (Bokun) using Stripe. All currency conversions are performed at the exchange rate in force at the time of payment.

      By paying your deposit or full balance to Simba, you confirm your agreement with these Terms and with our separate Cancellation Policy and Privacy Policy.

      3. Hotel Transfer Service

      Hotel transfers are included at no extra cost from most areas of Phuket. Your pickup time will be approximately one hour prior to tour departure, and you will be returned to your hotel in the evening at the end of your tour day.

      Booking cutoff for hotel transfer: Any booking made after 9pm the night before departure will not include the hotel transfer service. These customers are required to arrive at our office at Soho Pool Club, Boat Lagoon Marina, at least 30 minutes before the scheduled tour departure time.

      For hotels and accommodation outside Phuket, a per-vehicle transfer surcharge applies depending on the distance from our marina. We will advise you of the applicable fee when your booking is received. This can be paid on the day of your tour.

      We will confirm your exact pickup time the day before your tour.

      4. Cancellations & Refunds

      Our full cancellation and refund rules are set out in our Cancellation Policy, which forms part of these Terms.

      In summary:

      • Free cancellation up to 24 hours before tour commencement — full refund.
      • Cancellations within 24 hours, no-shows, or missed departures (including late arrivals via own transport) — 100% of the tour cost is charged. If Simba is subsequently able to re-book your seats to other customers, a full refund will be issued as soon as possible.
      • Cancellation due to illness — we will attempt to move you to an alternative date subject to availability. Where rescheduling is not possible, the cancellation policy above applies. On request we will issue a paid-in-full receipt you can submit to your travel insurance provider, along with supporting medical documentation you obtain from your doctor.
      • Cancellation due to Covid-19 infection — full refund with medical evidence.
      • Cancellation by Simba — if we cancel a tour for any reason (including bad weather assessed against the safety of the group, the vessel and current weather forecasts and satellite imagery) and we are unable to reschedule during your time in Phuket, we will refund 100% of the amount paid as soon as the cancellation is confirmed.

      Simba reserves the right to cancel, reschedule or change the tour type where minimum passenger numbers are not met, or for operational, safety or weather reasons. In these cases a full refund or alternative will be offered.

      5. Insurance

      Tour insurance is included in your tour package for passengers aged 3 months to 75 years only. Coverage applies from the time of hotel/resort pickup to the time of drop-off at your hotel/resort in the evening.

      Insurance cover is void if you do not provide the correct age of each member of the booking party and passport number at the time of booking.

      Important exclusions:

      • Back injuries, pregnancy and any other pre-existing medical conditions are not covered by any of our insurance policies, and we strongly recommend that customers with any of these conditions do not take part in any of our speed-boat tours. Simba Sea Trips Co. Ltd. shall not be held liable in any way for incidents on tour relating to any pre-existing medical conditions.
      • Personal belongings — no personal belongings such as cameras, phones, wallets, electronic devices or clothing are covered by our insurance in the event of loss or damage. NO EXCEPTIONS.
      • The insurance cover provided by Simba is limited in nature and may not extend beyond a reasonable level of base treatment and hospital care. For foreseeable injuries that might occur on tour the coverage is considered adequate.

      Any action Simba may take with respect to (1) assisting with organisation of medical assistance, or (2) allowing claims to be made under Simba's customer insurance policy, is conducted on a 'no liability' basis.

      We strongly recommend that all customers hold comprehensive personal travel insurance covering their full trip, in addition to the tour insurance we provide.

      6. Passenger Capacity & Suitability

      Our join-in group tours carry a maximum of 18 adults per tour. Where children or infants are travelling with adult family members, the total number of passengers on board may be up to 19. The adult maximum of 18 remains fixed in all circumstances.

      Our speed-boat tours involve fast travel across open sea and disembarking at remote beaches and lagoons. Customers are responsible for assessing their own suitability for this type of activity. If you have any medical condition, mobility limitation, recent injury, or other concern that may affect your participation, please contact us at sales@simbaseatrips.com before booking so we can advise.

      7. Passenger Conduct & Safety

      Safety on board is our highest priority. You agree to:

      • Follow all instructions given by the captain, guides and crew at all times.
      • Wear the life jacket provided whenever and wherever instructed.
      • Refrain from behaviour that endangers yourself, other customers, the crew or the vessel, including excessive intoxication, reckless swimming or ignoring safety briefings.
      • Remain within designated areas at beach and snorkeling stops, and return to the vessel at the times given by the crew.

      Simba reserves the right to refuse boarding, or to terminate a tour for any customer, whose behaviour is deemed unsafe, disruptive or a risk to others. In such cases no refund will be given.

      8. Images, Photos & Video

      During your tour, Simba's crew, guides and professional photographers may take photos and video footage of customers, group activities, beaches, snorkeling sites and other tour locations. By participating in a Simba tour, you agree that Simba may use these images and footage for promotional, marketing and editorial purposes — including (but not limited to) our website, social media channels, online travel agent listings, promotional materials and press.

      If you do not wish to have your image used in this way, please email sales@simbaseatrips.com or tell your guide at the start of the tour, and we will respect your preference.

      9. Changes & Substitutions

      Simba reserves the right to make reasonable changes to tour itineraries, destinations, timings, meal arrangements or vessels where necessary for safety, weather, operational or regulatory reasons. Where changes are substantial, we will notify you as soon as practicable and offer a suitable alternative or refund.

      Seasonal itinerary substitutions include, but are not limited to, the substitution of Bamboo Island for Maya Bay during the annual national park conservation closure (typically August–September). Where such substitutions apply, they are communicated in the tour listing.

      10. Liability

      Simba operates all tours with the highest regard for customer safety, using well-maintained vessels, certified crews, proper safety equipment and strict operational procedures. However, adventure activities in a marine environment inherently involve a degree of risk.

      To the maximum extent permitted by law, Simba's liability for any loss, damage, injury or claim arising from or in connection with a tour is limited to the amount paid by the customer for that tour, except where such liability cannot lawfully be excluded or limited.

      Nothing in these Terms excludes or limits Simba's liability for death or personal injury caused by its negligence, or for any other liability which cannot lawfully be excluded or limited.

      11. Governing Law & Jurisdiction

      These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with these Terms, your booking, or any tour operated by Simba shall be subject to the exclusive jurisdiction of the courts of Thailand.
